Leaking is bad man, and getting a lawsuit for leaking is something I've never seen before, and should really keep people from leaking.

These threats are meaningless if you choose the location of your servers carefully and familiarize yourself with the applicable laws.
If you have a backup, give someone else the chance to proceed.

By the way Yes! I support you. Why Gmod-Store should not distribute sites with Leak if it does not harm them in any way, since the owners themselves agree that their server can be hacked.
