Mybb is a free forum software. But there are premium plugins and themes for the site that people pay for to be more professional. People rip them, null them, or release the premium item for free. (And credits)
ZenithSlinkyDinky He's talking about why there is a release section for the various MyBB Versions if it's free (1.6.x and 1.8.x), not the plugins and themes.
And I have a feeling it's mainly due to the fact someone might not know when a new version of MyBB has been released, or where to download it. It also generates SEO for the community, which in turns allows for more members to join. It doesn't hurt anything, so I just wouldn't think too much about it.

Yes, though it's always better to support the developer that made them or purchase custom made ones yourself.

Although there was one case of guys emailing the server saying they were going to "sue". They never followed up on that claim afterwards. If you have the money, then pay for them. If not. Then use them I guess.
